Legal Preamble
This agreement constitutes a binding electronic agreement between Shaped ("Company", "we", "us") and the client or website user ("User", "Client", "you"). The Client acknowledges that clicking the "I Agree" box constitutes an express and final consent, serving as a legally binding "Electronic Signature" under the Saudi Electronic Transactions Law. By using our website or purchasing packages, you agree to these terms.
التمهيد
تشكل هذه الاتفاقية اتفاقية إلكترونية ملزمة بين منصة شيبد ("الشركة"، "نحن") وبين العميل أو مستخدم الموقع ("المستخدم"، "العميل"، "أنت"). يقر العميل بأن نقره على مربع (أوافق على الشروط والأحكام) عند شراء الباقة يعد موافقة صريحة ونهائية، وتعتبر بمثابة "توقيع إلكتروني" معتمد ونافذ قانوناً وفقاً لنظام التعاملات الإلكترونية السعودي. باستخدامك لموقعنا الإلكتروني أو شرائك للباقات، فإنك توافق على هذه الشروط.
Definitions
Package: refers to a prepaid bundle of training sessions. Session: refers to a scheduled training appointment. No-Show: refers to failure to attend a scheduled session.
التعريفات
الباقة: تعني مجموعة جلسات تدريب مدفوعة مسبقًا. الجلسة: تعني موعد تدريب مجدول. عدم الحضور: يعني عدم حضور الجلسة المجدولة.
Non-Refundable Packages
All training packages are non-refundable once purchased, regardless of usage, attendance, rescheduling, or personal circumstances.
الباقات غير القابلة للاسترداد
جميع باقات التدريب غير قابلة للاسترداد، بغض النظر عن مدى الاستخدام، أو الحضور، أو إعادة الجدولة، أو الظروف الشخصية.
Unused Sessions, No-Shows & Package Expiry Policy
The validity period of each package begins from the date of the first scheduled session recorded in the system, not the payment date, and runs continuously without interruption. Package validity is defined as follows: 1 Session Package: valid for 7 days 10 Sessions Package: valid for 6 weeks 20 Sessions Package: valid for 12 weeks 30 Sessions Package: valid for 16 weeks 40 Sessions Package: valid for 20 weeks 50 Sessions Package: valid for 6 months. Clients must complete all sessions within the assigned validity period. Any sessions not used within the validity period will be automatically forfeited without compensation or monetary refund, for any reason whatsoever, including travel, personal circumstances, or inability to attend. Package validity may not be frozen, extended, or reset under any circumstances.
الجلسات غير المستخدمة، عدم الحضور، وسياسة انتهاء صلاحية الباقة
تبدأ مدة صلاحية الباقة من تاريخ أول جلسة مجدولة في النظام، وليس من تاريخ الدفع، وتُحتسب بشكل متواصل دون توقف. مدة الصلاحية لكل باقة كالتالي: باقة جلسة واحدة: صلاحيتها 7 أيام؛ باقة 10 جلسات: صلاحيتها 6 أسابيع؛ باقة 20 جلسة: صلاحيتها 12 أسبوع؛ باقة 30 جلسة: صلاحيتها 16 أسبوع؛ باقة 40 جلسة: صلاحيتها 20 أسبوع؛ باقة 50 جلسة: صلاحيتها 6 أشهر. يجب على العميل استخدام جميع جلسات الباقة خلال مدة الصلاحية المحددة. أي جلسات غير مستخدمة خلال فترة الصلاحية تُعد ساقطة تلقائيًا دون تعويض أو استرجاع مالي، وذلك لأي سبب كان، بما في ذلك السفر أو الأعذار الطبية، أو الظروف الشخصية أو عدم التمكن من الحضور. ولا يتم إيقاف أو تمديد أو إعادة ضبط مدة صلاحية الباقة تحت أي ظرف.
Cancellations & Rescheduling
Cancellation and rescheduling requests must be submitted at least 12 hours before the scheduled session time. Rescheduling requests are subject to trainer availability and original or preferred time slots are not guaranteed.
الإلغاء وإعادة الجدولة
يجب تقديم طلبات الإلغاء وإعادة الجدولة قبل 12 ساعة على الأقل من وقت الجلسة المقرر. تخضع طلبات إعادة الجدولة لتوفر المدرب، ولا يتم ضمان المواعيد الأصلية أو المفضلة.
Session Timing, Delays & Unforeseen Circumstances
Due to the mobile nature of the services, Shaped and its trainers shall not be liable for delays, interruptions, or full session cancellations resulting from circumstances beyond reasonable control, including but not limited to illness, medical emergencies, traffic conditions, accidents, weather conditions, governmental actions, or other unforeseen events. In the event of trainer delay, the delay duration is added to the session time to ensure the full session is completed. If the session is fully cancelled by Shaped due to such circumstances, it will be rescheduled to the nearest available time that fits trainer availability, without any monetary compensation.
مواعيد الجلسات والتأخير والظروف الخارجة عن الإرادة
نظرًا لطبيعة الخدمات المتنقلة، لا تتحمل شِيبِد أو مدربوها أي مسؤولية عن أي تأخير أو انقطاع أو إلغاء كامل للجلسة ناتج عن ظروف خارجة عن السيطرة، بما في ذلك على سبيل المثال لا الحصر المرض، الحالات الطبية الطارئة، الازدحام المروري، الحوادث، الأحوال الجوية، الإجراءات الحكومية، أو أي أحداث غير متوقعة. ولا يترتب على ذلك أي استرداد مالي. وفي حال تأخر المدرب، يتم إضافة مدة التأخير إلى وقت الجلسة لضمان استكمال مدة الجلسة كاملة. وفي حال إلغاء الجلسة بالكامل من قبل شِيبِد بسبب هذه الظروف، يتم إعادة جدولتها في أقرب موعد متاح يتوافق مع توفر المدرب، دون أي تعويض مالي.
Training Equipment Policy
For General Fitness packages, trainers provide essential workout equipment. Pilates packages do not include Reformer machines. To train on a Reformer, the client must provide their own machine or choose mat Pilates as an alternative.
سياسة معدات التدريب
بالنسبة لباقات اللياقة البدنية العامة، يوفر المدربون معدات التمرين الأساسية. جميع باقات البيلاتس لا تشمل أجهزة الريفورمر. للتدريب على جهاز الريفورمر، يجب على العميل توفير جهازه الخاص أو اختيار المات بيلاتيس كبديل.
Payments & Fees
All payments are processed securely through Tap, a licensed online payment gateway. Payment processing fees, transaction fees, and shipping costs are non-refundable.
المدفوعات والرسوم
تتم معالجة جميع المدفوعات بشكل آمن عبر تاب، بوابة دفع إلكترونية مرخّصة. رسوم معالجة الدفع ورسوم العمليات وتكاليف الشحن غير قابلة للاسترداد.
Acceptance of Risk
The client acknowledges that fitness and training activities involve inherent risks, including but not limited to the risk of injury, medical complications, or physical strain, and voluntarily agrees to participate entirely at their own risk.
الإقرار بالمخاطر
يقر العميل بأن أنشطة اللياقة والتدريب تنطوي على مخاطر متأصلة، بما في ذلك على سبيل المثال لا الحصر خطر الإصابة أو المضاعفات الطبية أو الإجهاد البدني، ويوافق طوعاً على المشاركة على مسؤوليته الشخصية.
Indemnification
The client agrees to indemnify and hold harmless Shaped, its trainers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from misuse of services, failure to disclose medical conditions, negligence, or violation of these terms.
التعويض وإبراء الذمة
يوافق العميل على تعويض وإبراء ذمة شركة شيبد والمنصة ومدربيها وموظفيها والجهات التابعة لها من أي مطالبات أو أضرار أو التزامات أو تكاليف أو مصاريف تنشأ عن سوء استخدام الخدمات، أو عدم الإفصاح عن الحالات الطبية، أو الإهمال، أو مخالفة هذه الشروط.
Communications
By booking or purchasing, you agree to receive service-related communications, including booking confirmations, schedule updates, trainer coordination messages, policy updates, and service feedback or satisfaction survey invitations. These communications are considered operational and not marketing messages.
الاتصالات
بالحجز أو الشراء، فإنك توافق على تلقي الاتصالات المتعلقة بالخدمة، بما في ذلك تأكيدات الحجز، وتحديثات المواعيد، ورسائل تنسيق المدربين، وتحديثات السياسات، ودعوات المشاركة في استطلاعات الرأي المتعلقة بجودة الخدمة. وتُصنَّف هذه الاتصالات على أنها تشغيلية وليست تسويقية.
Service Scope
Shaped provides personal training, fitness, and Pilates services delivered at client locations or approved training environments. Services are delivered through assigned trainers based on availability and suitability. Trainer continuity is not guaranteed.
نطاق الخدمة
توفر شركة ومنصة شيبد خدمات التدريب الشخصي، واللياقة البدنية، والبيلاتس، ويتم تقديمها في مواقع العملاء أو في بيئات تدريب معتمدة. تُقدَّم الخدمات من خلال المدربين المعينين حسب التوافر، ولا يتم ضمان استمرار نفس المدرب لكل الجلسات.
Bookings & Packages
Services are sold as packages rather than individual sessions, and packages are subject to validity periods and expiry rules. Booking policies, cancellation rules, and expiry conditions are considered part of these Terms.
الحجوزات والباقات
تُباع الخدمات كباقات وليس كجلسات فردية، وتخضع الباقات لفترات صلاحية وقواعد انتهاء محددة. تشكل سياسات الحجز، وقواعد الإلغاء، وشروط انتهاء الصلاحية جزءًا من هذه الشروط.
Health Responsibility
Clients confirm that they are physically able to participate in training and are responsible for disclosing any injuries or medical conditions, consulting a physician before starting training if needed, and informing trainers of any limitations. Participation in training is undertaken at the client's own risk.
المسؤولية الصحية
يؤكد العملاء أنهم قادرون جسديًا على المشاركة في التدريب، وهم مسؤولون عن الإفصاح عن أي إصابات أو حالات طبية، واستشارة الطبيب قبل بدء التدريب إذا لزم الأمر، وإبلاغ المدربين بأي قيود لديهم. يتم المشاركة في التدريب على مسؤولية العميل الخاصة.
Results Disclaimer
Shaped does not guarantee specific fitness, health, or aesthetic results, as outcomes vary based on individual commitment, lifestyle, nutrition, and medical factors.
إخلاء مسؤولية النتائج
لا تضمن شركة شيبد تحقيق نتائج محددة في اللياقة أو الصحة أو المظهر، حيث تختلف النتائج بناءً على التزام العميل ونمط حياته وتغذيته والعوامل الطبية.
Trainer Replacement
Shaped reserves the right to replace or reassign trainers, when necessary, without liability, provided the replacement holds appropriate qualifications.
استبدال المدربين
تحتفظ شركة شيبد بالحق في استبدال أو إعادة تعيين المدربين عند الحاجة دون أي مسؤولية، شريطة أن يكون المدرب البديل مؤهلاً بشكل مناسب.
Non-Transferable Packages
Training packages are non-transferable, non-sharable, and may not be resold under any circumstances.
الباقات غير قابلة للتحويل
الباقات التدريبية غير قابلة للتحويل أو المشاركة أو إعادة البيع تحت أي ظرف.
Limitation of Liability
To the maximum extent permitted by law, Shaped and its trainers are not liable for any injuries resulting from participation in training, nor for any indirect or consequential losses. They are also not responsible for outcomes that do not meet client expectations or for issues arising from inaccurate information provided by the client.
تحديد المسؤولية
إلى أقصى حد يسمح به القانون، فإن شركة شيبد ومدربيها غير مسؤولين عن أي إصابات ناتجة عن المشاركة في التدريب، ولا عن أي خسائر غير مباشرة أو تبعية. كما أنهم غير مسؤولين عن النتائج التي لا تلبي توقعات العميل أو عن المشكلات الناشئة عن معلومات غير دقيقة يقدمها العميل.
Trainer Conduct & Environment
Clients must provide a safe and suitable training space, accurate location details, and treat trainers with respect. Shaped reserves the right to refuse or discontinue service in unsafe or inappropriate environments.
سلوك المدرب وبيئة التدريب
يجب على العملاء توفير مساحة تدريب آمنة ومناسبة، وتقديم تفاصيل الموقع بدقة، والتعامل مع المدربين باحترام. تحتفظ شركة ومنصة شيبد بالحق في رفض أو إيقاف الخدمة في البيئات غير الآمنة أو غير الملائمة.
Technology & Platform Use
We are not liable for website downtime, interruptions in the booking system, failures of third-party payment gateways, or outages of messaging platforms such as WhatsApp or Instagram.
استخدام التقنية والمنصة
لا تتحمل منصة شيبد أي مسؤولية عن توقف الموقع الإلكتروني، أو انقطاع نظام الحجز، أو فشل بوابات الدفع التابعة لجهات خارجية، أو انقطاع منصات الرسائل مثل واتساب أو إنستغرام.
Misuse & Abuse
Shaped may suspend or refuse service if there is any abuse toward staff or trainers, misuse of booking slots, fraudulent payment behavior, or violations of platform policies.
سوء الاستخدام وإساءة الاستعمال
قد تقوم شركة شيبد بتعليق أو رفض الخدمة في حال وجود أي إساءة تجاه الموظفين أو المدربين، أو سوء استخدام مواعيد الحجز، أو سلوكيات دفع احتيالية، أو انتهاكات لسياسات الشركة والمنصة.
Privacy Policy
Shaped is committed to processing personal data in accordance with the Personal Data Protection Law (PDPL) and its executive regulations in the Kingdom of Saudi Arabia issued by the Saudi Data & AI Authority (SDAIA). By using our website, booking services, or purchasing training packages, you agree to this Privacy Policy and Terms of Use.

تلتزم شركة شيبد بمعالجة البيانات الشخصية وفقاً لنظام حماية البيانات الشخصية (PDPL) ولائحته التنفيذية في المملكة العربية السعودية الصادرة عن الهيئة السعودية للبيانات والذكاء الاصطناعي (سدايا). باستخدامك لموقعنا الإلكتروني، أو حجزك للخدمات، أو شرائك لباقات التدريب، فإنك توافق على سياسة الخصوصية وشروط الاستخدام الخاصة بنا.
Data We Collect
We follow the principle of data minimization and collect only the data necessary to deliver our services. This may include your full name, mobile number, email address, location or address for session delivery, booking and scheduling details, package purchase history, trainer assignment records, health or fitness notes voluntarily shared by you, messages and communications through WhatsApp, Instagram, or website forms, as well as payment confirmation records (payments are processed through Tap, and we do not store card data).

نلتزم بمبدأ تقليل البيانات ولا نقوم بجمع إلا البيانات الضرورية لتقديم خدماتنا. وقد يشمل ذلك الاسم الكامل، ورقم الجوال، والبريد الإلكتروني، والموقع أو العنوان لتقديم الجلسات، وتفاصيل الحجز والمواعيد، وسجل شراء الباقات، وسجلات تعيين المدربين، والملاحظات الصحية أو المتعلقة باللياقة التي يشاركها العميل طوعًا، بالإضافة إلى الرسائل والمراسلات عبر واتساب أو إنستغرام أو نماذج الموقع الإلكتروني، وسجلات تأكيد الدفع (حيث تتم معالجة المدفوعات عبر تاب ولا نقوم بتخزين بيانات البطاقات البنكية).
Purpose of Data Processing
Your data is processed strictly for operational purposes, including scheduling and delivering training sessions, assigning suitable trainers, managing bookings and packages, processing payments, providing customer support and communication, improving services and monitoring quality, complying with legal and regulatory requirements, and supporting internal reporting and business operations. We do not use personal data for any unrelated purposes.
غرض معالجة البيانات
تتم معالجة بياناتك لأغراض تشغيلية بحتة، بما في ذلك جدولة وتقديم جلسات التدريب، وتعيين المدربين المناسبين، وإدارة الحجوزات والباقات، ومعالجة المدفوعات، وتقديم دعم العملاء والتواصل، وتحسين الخدمات ومراقبة الجودة، والامتثال للمتطلبات القانونية والتنظيمية، ودعم التقارير الداخلية وعمليات الأعمال. نحن لا نستخدم البيانات الشخصية لأي أغراض غير ذات صلة.
Payment Data
All payments are processed through licensed third-party payment gateways (Tap). Shaped does not store debit or credit card numbers, and we only retain transaction confirmations and records of payment status.
بيانات الدفع
تتم معالجة جميع المدفوعات عبر بوابات دفع تابعة لجهات خارجية ومرخصة (تاب). لا تقوم شركة ومنصة شيبد بتخزين أرقام بطاقات الخصم أو الائتمان، ونحتفظ فقط بتأكيدات المعاملات وسجلات حالة الدفع.
Data Sharing
We do not sell or rent personal data. Data may only be shared with assigned trainers strictly for service delivery, payment processors, technical service providers such as booking systems, hosting, and communication tools, and government authorities when legally required. All partners are bound by confidentiality obligations.
مشاركة البيانات
لا نقوم ببيع أو تأجير البيانات الشخصية. يمكن فقط مشاركة البيانات مع المدربين المعينين لأغراض تقديم الخدمة، ومع معالجي المدفوعات، ومقدمي الخدمات التقنية مثل أنظمة الحجز والاستضافة وأدوات التواصل، والسلطات الحكومية عند الطلب القانوني. جميع الشركاء ملتزمون بالتزامات السرية.
Data Storage & Protection
Data is stored using secure systems with access controls, and access is limited to authorized personnel only. Reasonable technical and administrative safeguards are applied to protect the data, which is retained only as long as necessary for service delivery and legal purposes.
تخزين البيانات وحمايتها
يتم تخزين البيانات باستخدام أنظمة آمنة مع ضوابط وصول، ويقتصر الوصول على الأشخاص المخولين فقط. يتم تطبيق تدابير وقائية تقنية وإدارية معقولة لحماية البيانات، ولا تُحتفظ بالبيانات إلا طالما كانت ضرورية لتقديم الخدمة والأغراض القانونية.
User Rights Under PDPL
Under the Saudi PDPL, you have the right to be informed about how your data is processed, to access your personal data, to request correction or updates, to request deletion where legally permitted, and to withdraw consent where applicable. Requests can be submitted through Shaped customer support.
حقوق المستخدم بموجب نظام حماية البيانات الشخصية
بموجب نظام حماية البيانات الشخصية السعودي (PDPL)، لديك الحق في معرفة كيفية معالجة بياناتك، والوصول إلى بياناتك الشخصية، وطلب تصحيحها أو تحديثها، وطلب حذفها عندما يسمح القانون بذلك، وسحب موافقتك عند انطباق ذلك. يمكن تقديم الطلبات من خلال دعم عملاء منصة شيبد.
Amendments
We may update policies when needed. Continued use of services after updates constitutes acceptance.
التعديلات
يجوز لنا تحديث السياسات عند الحاجة. ويعتبر استمرار استخدام الخدمات بعد أي تحديثات بمثابة قبول بالتغييرات.
Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia and any disputes fall under Saudi jurisdiction.
القانون الواجب التطبيق
تحكم هذه الشروط قوانين المملكة العربية السعودية وتخضع أي نزاعات للاختصاص القضائي في المملكة العربية السعودية.
